  • Process Servers: Maine also allows for process servers who are licensed and authorized to serve legal documents.
  • Personal Service: Delivering the documents directly to the individual or entity being served.
  • Service at the Dwelling or Usual Place of Abode: Leaving the documents with someone of suitable age and discretion residing at the individual’s usual place of abode.

  • Prompt Service: Maine rules require that service of process be accomplished within a reasonable time after filing the complaint. The specific timeframe can be determined by the court but generally should be within 90 days of filing the complaint.
  • Affidavit of Service: After serving the documents, the server must complete an affidavit of service detailing the time, date, manner of service, and identity of the person served.
  • Filing Proof of Service: This affidavit must be filed with the court to show that service has been properly executed.

  • Service on the State or State Agencies: Involves serving the attorney general or an assistant attorney general.
  • Court Permission: If traditional methods of service are impractical, a party can request the court’s permission to use an alternative method, which may include electronic means or other methods reasonably calculated to give actual notice.
  • Maine Rules of Civil Procedure: Ensure that all service of process complies with the relevant rules and statutes, primarily outlined in the Maine Rules of Civil Procedure, particularly Rule 4.
