  • Service of process must be performed by a sheriff, deputy sheriff, or a licensed private detective. In some cases, a special process server can be appointed by the court.
  • Personal Service: Delivering the summons and complaint directly to the defendant.
  • Substituted Service: If the defendant is not available, documents can be left with someone at the defendant’s usual place of abode (home), who is at least 13 years old, and informing that person of the contents. A copy must also be mailed to the defendant’s last known address.
  • Service by Publication: If the defendant cannot be located despite diligent efforts, the court may allow service by publication in a newspaper
  • Service must be made within the time specified by the court, usually within 30 days of filing the complaint. Extensions may be granted upon showing good cause.
  • Proof of service must be filed with the court, typically in the form of an affidavit from the person who served the documents, detailing the date, time, and method of service.
  • Corporations: Service can be made on an officer, registered agent, or any agent authorized by appointment or law to receive service of process.
  • Partnerships: Service can be made on any partner or an agent authorized to receive process.
  • Government Entities: Specific rules apply depending on the type of government entity (e.g., state, county, municipal).
  • The summons and complaint must be properly completed, indicating the names of the parties involved, the court in which the action is brought, and other relevant details.
  • Ensure that the court has jurisdiction over the defendant. Service must comply with Illinois law and constitutional requirements of due process.
  • Illinois allows service on defendants outside the state in accordance with state long-arm statutes, provided that the defendant has sufficient minimum contacts with Illinois.

If a defendant is avoiding service, Illinois law provides mechanisms such as motion for alternate service, which might include service by mail or electronic means if authorized by the court.
